Program Details, Concept and Participation:
- These terms and conditions apply to Navratna Ayurvedic Oil and Navratna Extra Thanda Ayurvedic Oil Consumer Program (hereinafter referred to as "Program") for voluntary participation of consumers, sponsored and launched by Emami Ltd having its office at 687, Anandapur, E M Bypass, Kolkata 700107, West Bengal, (hereinafter referred to as ‘the Company’), and conducted by QwikCilver, having its office at No. 111, 1st floor, “Brigade Manae Court”, Industrial Layout, Koramangala 5th Block, Bangalore 560095 (hereinafter referred to as “Agency”) wherein consumers can participate by sending an SMS of the 6 digit Batch No. (herein referred to as the “Code”)printed on Navratna Ayurvedic Oil Pack– 50 ml, 100 ml, 200 ml, 300 ml & 500 ml & Navratna Extra Thanda Ayurvedic Oil Pack– 50 ml and 500 ml (hereinafter referred to as the “Consumer Program Pack”).
- The Program is valid only in India (subject to the exceptions mentioned hereinafter) from 01/05/2021 to 31/07/2021 (herein after referred as "Program Period") & between 10 AM to 6 PM (here in after referred as "Program Timings"). The Program is valid throughout India (except the State of Tamil Nadu). The Program is open to Citizens of India only.
- Participating during the Program Period, the Participant stands a chance to win either cash prize of Rs 100/- or a Grand prize as categorized hereinafter. A total of 44160 (every minute Rs 100/- Cash Prize to a winner) winners will be drawn for cash prizes of Rs 100/-, subject to available eligible participations every minute, and a total of 32 winners will be drawn for Grand prizes, as per the process enumerated hereinafter. Grand prize shall mean and include Samsung Mobile (Samsung M01, 2GB & 32GB), Mi Television (MI 4A Pro 80 cm), HP Laptop (HP-15s-du1052TU), Honda Activa (Activa 6G STD Ex-showroom Delhi) & Maruti Swift (Swift VXI Ex-Showroom Delhi). Prizes are indicative only & actual prize may vary as per the sole discretion of the Company. Prizes are subject to availability, continuation of model & other factors as to be decided by the Company. The number and type of Grand Prizes can be amended by Emami Ltd/its agency at its discretion. Participation more than once by any participant will be automatically rejected.
- The Program period starts from 1st May 2021 and shall be valid till 31st July 2021. However, a customer who has bought a pack before 1st May 2021, will also be eligible for participation in the Program but strictly during the phase of Program timing within the Program Period (1st May 2021 – 31st July 2021). All participations prior to or after the Program Period and not within the Program timing will be automatically considered as ineligible.
- The Program is subject to all applicable Central, State and local laws and regulations.
- Consumers participating or seeking to participate in the Program shall individually be referred to as "Participant" and collectively as "Participants".
- Regular call and message rates will apply as per the consumer telecom operator in their respective circle to be borne by the Participant.
- Participant winning cash prize of Rs 100/- will get an option to choose from UPI & NEFT, and will have to provide either UPI ID or NEFT details. The Participant will solely be responsible for entering accurate details such as UPI ID, Bank Account Number, Bank Name, IFSC code, and other Personal Identified Information as a part of Program as required for the process. Emami Ltd & Qwikcilver will not be responsible for any incorrect entries or details provided by the Participant in the said process. No changes & other such requests pertaining to the details shall be entertained once Participant submits the details. In case the details entered by the winner are incorrect leading to a failed transaction, Emami Ltd reserves the right to NOT declare the winner for that corresponding minute. Emami Ltd, at its discretion, can also choose a winner in lieu of these failed transactions – from the pool of participants available with them.
- Participant winning Grand prize will have to share address details & KYC details. Accordingly, further steps for reward fulfilment will be planned. Participant should provide correct information related to address details, PAN & other information as will be sought by the Company).
- Emami Ltd/ its Agency reserves right to cancel / amend / extend the Program Period and Program Timings at any time at its absolute discretion without giving any notice/intimation. No claims/questions/complaints shall be entertained in this regard.
Agreement to Terms and Conditions:
- By participating in this Program, Participants fully and unconditionally agree to and accept these Terms and Conditions available on www.woohoo.in/navratnaoil (“Program Website") as well as the decisions of Emami Ltd & Qwikcilver, which are final and binding in all matters related to the Program. Successful participation in the Program and winning a prize is subject to fulfilment of all terms and conditions mentioned herein.
- Emami Ltd reserves the right to exclude any person from the Program on grounds of misconduct or criminal record or non-compliance of any conditions stipulated in the Program.
- Emami Ltd reserves the right to terminate, modify or extend the Program, at any time at its absolute discretion, without assigning any reason. All decisions of Emami Ltd in respect of the Program, eligibility of Participant, selection of winners and the prizes therein will be final and binding upon the Participants.
- If this Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Emami Ltd and/or its Agency, including but not limited to technical difficulties, unauthorized intervention or fraud, Emami Ltd / Agency reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Program, as appropriate.
- If for any reason this Program turns incapable of continuation as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of Emami Ltd or the Agency, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Program, Emami Ltd/its Agency Reserves the right in its sole discretion to cancel, terminate, modify or suspend the Program.
- Rights to use data - By participating in this Program:
  - The participant expressly confirms and represents that he/she has read the Terms & Conditions of the Program on how to participate, and enter details on usage, collection, retention and sharing of personal data;
  - The participant agrees to be bound by the terms, in particular those relating to the collection, retention, use and sharing of personal data.
  - The participant confirms that he/ she has gone through Emami Ltd & Qwikcilver privacy policy and that he/ she has no objection in collection or processing of their data by Emami Ltd & Qwikcilver according to the manner carved out in the privacy policy.
  - The Participant’s personal data as collected by Emami Ltd associates/partners/affiliates or its Agency shall be passed to Emami Ltd . The personal data shall be administered and treated under Emami Ltd & Qwikcilver privacy and data collection guidelines. Such data collected and retained may be used by Emami Ltd and or its related associates/partners/ affiliates for communication, promotion, marketing, internal study, and data analysis purposes.
  - Emami Ltd mandates participants to read its /Qwikcilver privacy and data collection guidelines before sharing personal data. If the Participant does not want his / her personal data to be collected by or shared with a company other than Emami Ltd & Qwikcilver the Participant can always choose not to participate in such activity.
  - If Participants have any questions or comments regarding this Privacy Notice or Emami Ltd personal data collection practices, please mail at customercare@emamigroup.com
  - Emami Ltd and the Agency shall not be responsible for (including but not limited to):
    - - any SPAM generated messages
    - - the Operator Code not being displayed on the user's mobile phones
    - - any SMS message delivery failures
    - - Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason
    - - If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign
    - - Other conditions beyond its reasonable control
Eligibility:
- This Program will be open to all the residents of India with the exception of State of Tamil Nadu and the phone numbers belonging to the state of Tamil Nadu telecom circle.
- Employees of Emami Limited, the Agency, advertising agencies, distributors / Sub-Stockist, Super-stockist or Retailer or Wholesaler and/or their respective immediate family members are not eligible to participate in the Program. Also, persons reporting regularly to Emami Limited, Agency, sponsor, advertiser and/or their respective immediate family members and anyone who, by the nature of the connection with Emami Ltd / Agency, may have a direct & personal knowledge of the Program are disqualified from participating in the Program.
- Emami Ltd or the Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. Participation in the program by any Participant shall make him/her a subject of the terms and conditions enumerated herein and accordingly, shall be bound by the same. All participants shall be deemed to have allowed Emami Ltd and/or the Agency to call them for promotion, marketing or winner management purposes even if they are registered under NDNC, DND (Do Not Disturb) by virtue of them having voluntarily participated in the Program.
Program Timings:
- The Participants who send the valid and correct SMS between 10 AM to 6 PM (here in after referred as "Program Timings") during the Program Period are eligible to participate in the Program.
- Time of participation will be defined as the time at which the entry is received through the SMS mode of participation at Agency’s computer system.
- Entries coming outside the Program Period & Program Timings will not be considered for winner selection and shall be automatically rejected.
- The Program is applicable on specific pack of Navratna Ayurvedic Oil – 50 ml, 100 ml, 200 ml, 300 ml & 500 ml & Navratna Extra Thanda Ayurvedic Oil – 50 ml and 500 ml (hereinafter referred to as the “Consumer Program Pack”).
Prize :
- 444160 (every minute Rs 100/- Cash Prize to a winner) winners for cash prize of Rs.100/- each, subject to eligible participation every minute, & 32 Grand prize winners will be chosen from amongst all Participants in a 61-day Program Period (1st May 2021 at 31st July 2021) & Program Timings (10 AM to 6 PM) every day. Every minute one selected winner can select either UPI or NEFT and share complete information as required to receive Rs 100/- cash prizes. Grand prize winner can win any of reward including Samsung Mobile (Samsung M01, 2GB & 32GB), Mi Television (MI 4A Pro 80 cm), HP Laptop (HP-15s-du1052TU), Honda Activa (Activa 6G STD Ex-showroom Delhi) & Maruti Swift (Swift VXI Ex-Showroom Delhi). Prizes are indicative only & actual prize may vary. Prizes are subject to availability, continuation of model & other factors. One participant can win maximum up to once & cannot win more than 1 prize.
- Winners will be chosen through a computerized, scientific random selection by the Agency, and decision of Emami will be final and binding upon the participants.
How to Participate:
To participate in the Program, Participants are required to follow the below steps:
- As a first step, a Participant is required to send an SMS to a designated number as stated herein below with 6 digit Batch Number printed on Promo Pack from any GSM or CDMA mobile phone
  e.g. NRT<SPACE> 6 digit Batch Number to 8108590859 – For participants buying Navratna Ayurvedic Oil – 50 ml, 100 ml, 200 ml, 300 ml & 500 ml
  OR
  NRT<SPACE> 6 digit Batch Number to 8108590859 - For participants buying Navratna Extra Thanda Ayurvedic Oil – 50 ml and 500 ml
- After sending the SMS, the Participant will get a confirmation through an SMS about his/her participation.
- In case the Participant is a winner for Rs 100/-, Participant shall receive congratulations SMS along with a winning code within 72 hours. Participant will click on the link, enter winning code, enter mobile number & do OTP validation. Participant to choose between 2 options - UPI or NEFT. Basis the option selected, winner to provide UPI ID or Bank details including IFSC Code, Bank name, Bank Address, Account Number etc. Within 7 working days (excluding bank holidays, Saturday and Sunday) from the date of filling the correct details winner shall receive Rs 100 /- as the prize. In case details entered by participant are incorrect, Emami Ltd/its agency shall have no responsibility and/or obligation to grant the said prize and requests for change of such details, if any, shall be the sole discretion of Emami Ltd.. Emami Ltd/its agency reserves the right to NOT declare any replacement winner in lieu of all such winners entering wrong details.
- For Grand prizes, winners will be selected on weekly & monthly basis. Grand prize winners shall receive congratulation SMS along with winning code. Participant will click on the link, enter winning code, enter mobile number, fill their address & other such Personal Identified Information as required. Winners may also be required to furnish the pack containing the batch code as proof of purchase. Winners will also need to upload a video sharing their experience with the brand. Post sharing complete requirements of data as aforesaid and further information , if any required by Emami Ltd , a winner of such category shall receive reward within 30 days. In case incomplete information is provided or Emami Ltd/its Agency is not satisfied by the accuracy of the details, Emami Ltd/its Agency has the right to refuse the Grand Prize to the selected winner and may either choose a replacement winner or choose not to declare any replacement winner.
- 1 mobile number can participate only once during the entire Program Period & program Timing
- Selection of Winner shall be subject to fulfilment of all terms and conditions of the Program
Winner Selection:
- A draw through random scientific selection will be conducted every day for the previous day’s entries for selection on the winners
- For Every Minute Prize, a total of 480 winners will be selected wherein winners will be selected every minute, subject to eligible participation every minute between 10 AM to 6PM (i.e. 480 Winners for 480 Minutes) through a scientific random method for every day during the program period. For Grand prize, 32 Participants will be selected as winner during the entire Program Period.
- Prizes will be given subject to the winner satisfying the verification process of Emami Ltd Ltd. or the Partner Agency.
- Participants have a chance to win 1 time only from a single mobile number.
- The winner generation will be done based on Valid Code and mobile number
- Emami Ltd Ltd. and Partner Agency shall have a right to ask for the original packs as part of the verification of the winner or in case of any query raised by the Participants during the Program Period. Non – submission of the pack shall render the Participant as not eligible to participate in the Program.
Contacting Winners:
- Once the Winners are selected, the Partner Agency appointed by Emami Ltd shall process the grant of Rs 100/- cash prizes within 7 working days (excluding public holidays, Saturday & Sunday) and shall process the grant of Grand prizes within 30 days (excluding public holidays, Saturday & Sunday) from the time of winners sharing correct & complete information. Winners will also get a confirmatory message of having won Rs 100 /- or Grand prizes. The winner list will also be published on the Program website www.woohoo.in/navratnaoil
- In case the winner is less than 18 years of age, an undertaking from the Parent / Legal Guardian in the desired format as prescribed by Emami Ltd, as well as valid proof for establishing Parent / Legal Guardian Status shall be needed. Parent / Legal guardian will also be required to submit a valid PAN Card.
- For Grand Prizes winners, the following rules shall be applicable:
  - Emami Ltd at its discretion may ask the Winners to furnish any or all the following documents:
    Aadhar, Pan Number, ID Card, Passport, Driving License or similar government ID
  - Winners will be required to retain and furnish on demand the outer carton of the bottle having the 6 digit batch number.
  - Winners will be required to furnish a proof of ownership of participating mobile number (Mobile bill or a letter from their Network service provider clearly stating the mobile number, their name, address etc.)
  - Identification details (Name) on the identification document furnished should match the same on Mobile Bill / Letter furnished by network service provider
  - Winners will also need to upload a video sharing their experience with the brand.
  - Eligibility will be scrutinized by an independent auditor, and Agency will contact the winner once documents furnished are scrutinized and found to be acceptable.
  - In case any one of the above documents are not available for any reason, the Emami Ltd / Agency reserves the right to take a decision in respect of the grant of the prize in issue.This decision will be final and binding upon the Participants.
Publicity:
- The Participant/s undertake and irrevocably and unconditionally permit Emami Ltd to cover the Program through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.
- The winners must, at the request of Emami Ltd participate in all Program activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and participation in the Program by the Participant shall be deemed to be his/her consent to Emami Ltd for using their name and image in Program material.
Intellectual Property:
- All right, title and interest, including but not limited to the Intellectual Property Rights, in the Program material(s) and in any and all responses received shall vest solely and exclusively with Emami Ltd at all times. Emami Ltd or any person or entity permitted by Emami Ltd in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Program, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
- All materials submitted in connection with the Program (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants shall be deemed to be ipso facto assigned to Emami Ltd upon submission, and the same shall become the property of Emami Ltd exclusively. Emami Ltd may use the material in any medium in any reasonable manner it seems fit. Copyright in any such material remains the sole property of Emami Ltd.
General Conditions :
- Each Participant represents and warrants that he/she is legally competent to enter binding contracts under applicable laws. By taking part and/or entering the Program, the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
- The decision of Emami Ltd or its Agency, as regards the selection of winners and distribution of the prizes shall be final, subject only to Emami Ltd’s approval. No correspondence or any other claims whatsoever, in this regard will be entertained.
- No queries, claims, dispute, complaints, or grievances from any participant and/or his/her heirs, successors, agents and/or anyone under or in trust of him/her shall be entertained by Emami Ltd and its Agency after 30 days from the date of the closure of the Program.
- A Grand prize cannot be exchanged and is not transferable and cannot be converted into cash.
- Emami Ltd reserves the right to change, defer, alter or cancel this Program in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of Emami Ltd in this regard and in general with respect to this Program and the terms and conditions thereto shall be final, binding and non-negotiable.
- Nothing contained herein amounts to a commitment or representation by Emami Ltd to conduct further Programs.
- The decision of Emami Ltd shall be final in all regards and no communication challenging the same shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or Partner Agency between any Participant and Emami Ltd and the Participant shall not have the authority to bind Emami Ltd in any manner whatsoever
- Emami Ltd or any of its respective officers/employees/directors shall not be responsible for delayed, lost, mutilated, corrupted or illegible documents etc.
- Emami Ltd or its Agency shall not be liable to perform any of its/their respective obligations under the Program or in respect of the prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, pandemics, epidemics, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.
- Emami Ltd or it’s Agency shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Program due to any government restrictions.
- Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of Emami Ltd or its Agency.
- Emami Ltd or its Agency accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. Emami Ltd or it’s Agency shall not be liable for any consequences of user error including (without limitation) costs incurred.
- If a Participant is dissatisfied with the Program or the Program rules and/or any content or any requirements of the Program form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Program.
- If a person chooses to access the Program Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.
- The operational part of the Program like transferring cash amount of Rs 100/-, dispatching Grand prizes shall be managed by Agency.
- The participation in the Program is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.
- To participate in this Program Regular call and message rates shall apply
- To participate in this Program, Standard fair usage policy and usage norms set by the respective telecom operator shall apply
- The Program is subject to the guidelines/directions issued by the Telecom Regulatory Authority of India, Department of Telecommunications, and any governmental or statutory authority as may be applicable from time to time.
- In case of queries, consumers can reach out to Partner Agency on 080-67181401 from Monday to Saturday, 10:30 AM to 5:30 PM. Lines will be closed on public and bank holidays. Standard calling rates apply.
- The Agency / Emami Ltd is not responsible for Non-Delivery or receipt of an SMS by their servers or on the end users device due to customer handset issues, network issues or due to any issues at cellular operator’s end. By participating in this program the customer understands that all such queries are to be directed to their current service provider directly and not hold Agency or Emami Ltd responsible for the same.
Release and Limitations of Liability:
- Emami Ltd and its Agency shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of acceptance of any prize.
- By entering the Program the Participant hereby releases from and agrees to indemnify Emami Ltd and/ or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the prize or participation in the Program including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
- Emami Ltd and its Agency accept no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself, Agency or third parties in relation to the prizes.
- The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Program by conducting an illegal act. Participant also undertakes to indemnify Emami Ltd and/or its Agency and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by Emami Ltd or its Agency on account of such act on the part of the Participant.
- In consideration of Emami Ltd allowing the Participant/s to take part in the Program, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Emami Ltd its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Program or related to the Program or the prize of the Program.
Dispute:
- The courts of competent jurisdiction at Kolkata shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Program. Participation in the Program is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.
- Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or Emami Ltd and/or its Agency of this Program, shall be governed and construed in accordance with the laws of the Republic of India.

I have purchased Navratna Big Boss offer pack. How do I participate?

Does my valid participation in Navratna Big Boss Offer guarantee that I will win any of the prizes?

What is the Big Boss Offer Period and Timings for Participation?
The Program period starts from 1st May 2021 and shall be valid till 31st July 2021. How many times can I participate in Navratna Big Boss Offer?

I have purchased a Navratna Ayurvedic Oil Bottle during program period. But there is no mention of Big Boss offer details mentioned on pack. Why is it so?
Packs without the Big Boss Offer are also available in the market.
How will the winners be chosen?
Winners will be chosen through a computerized, scientific random selection by the Agency(QwikCilver), and decision of Emami will be final and binding upon the participants.
How will I know that I am declared a winner?

Once the Winners are selected, the Partner Agency appointed by Emami Ltd shall process the grant of Rs 100/- cash prizes within 7 working days (excluding public holidays, Saturday & Sunday) from the time of winners sharing correct & complete information. Do I need to retain the pack to claim my prize?
Emami Ltd. and Partner Agency shall have a right to ask for the original packs as part of the verification of the winner or in case of any query raised by the Participants during the Program Period. Non-submission of the pack shall render the Participant as not eligible to participate in the Program.
