Terms & Conditions

The terms and conditions apply to the Program “Hersheys Exotic Dark Chocolates Program” (thereinafter referred to as Program) for consumers purchasing the product unit worth MRP Rs 150.00 (incl. of all taxes) of Hersheys Exotic Dark chocolates that carries communication regarding the Program (hereinafter referred to as “Promotion Product”) sponsored by Hersheys India Pvt Limited and conducted & managed by Pinelabs Private Limited (hereinafter referred to as “Organizer”) wherein consumer can win assured Book My Show voucher of Rs 100. Book My Show voucher can apply on Book My Show application/ website in accordance with the following terms and conditions.
The Program will start on 10th Aug 2023 and end on 10th FEB 2024 (both days inclusive) (Program period)
Entries would be valid if: -
- Message is sent via SMS in correct format. (Accepted Format is “HERSHEYSHED <space> 12-character alpha numeric unique code on 7036186000”).
- One mobile number can participate only once in a single calendar month i.e. maximum up to 6 times with 6 unique codes to win 6 Book My Show codes worth Rs 100 each during the promo period.
Consumers participating or seeking to participate in the Program shall individually be referred to as "Participant" and collectively as "Participants”.
The consumer needs to find the 12-character unique code on Hersheys Exotic Dark Chocolates Consumer Promo pack and send the participation via SMS in the correct format on the number provided above. This 12-character unique code is mentioned on the inner side of the promo pack.
Basis valid SMS entry, participant to get an Book My Show voucher worth Rs 100.
Book My Show voucher will have a 6 months validity from the date of receiving the Book My Show voucher.
The Program is valid across India.
Hersheys India Limited and Partner Agency shall have a right to ask for the original packs in case of any query raised by the Participants during the Program Period, non – submission of which shall render the Participant as not eligible to participate in the Program.
Participation in this Promotion is purely voluntary and optional. This Program is not in conjunction with any other Program.
Products are also available without this Program. By participating in this Program, each participant is deemed to have accepted these terms and conditions.
This Program is being conducted by the Organizer and sponsored by Hersheys India Limited during the Program Period defined hereinafter.
The Program period is valid till 10th FEB 2024, 23:59 Hours.
Any entries attempted and/or made before or after the prescribed/allotted time will summarily be rejected.
The Program Period is subject to change and may be extended/modified/amended at the absolute discretion of the organizer, i.e., Hersheys India Ltd.
How to Participate:
- Find 12-character alphanumeric unique code on the inner side of the promo pack.
- To register, SMS “HERSHEYSHED <space> 12-character alpha numeric unique code on 7036186000
- Participant will get a Book My Show code worth Rs 100.
- Hersheys India Limited at its discretion may ask the Winners to furnish the any or all the following documents:
  - a. Aadhar, Pan Number, ID Card, Passport, Driving License, or similar government ID.
  - b. Winners will be required to retain and furnish on demand the wrapper of the pack with the winning code.
  - c. Winners will be required to furnish a proof of ownership of participating mobile number (Mobile bill or a letter from their Network service provider clearly stating the mobile number, their name, address etc.)
  - d. Identification details (Name) on the identification document furnished should match the same on Mobile Bill / Letter furnished by network service provider.
  - e. In case the winner is less than 18 years of age, an undertaking, as well as valid proof for establishing Parent / Legal Guardian Status will then be needed. Parent/Legal guardian will also be required to submit a valid PAN Card.
  - f. Eligibility will be scrutinized by an independent auditor, and Agency will contact the winner once documents furnished are scrutinized and found to be acceptable.
  - g. In case any one of the above documents are not available for any reason, the Hershey India Limited/ Agency reserves the right to take a decision basis the availability of other documents. This decision will be final and binding.
Process to redeem Book My Show Gift Card code: -
- Log on to in.bookmyshow.com or BookMyShow Mobile App.
- Select Location, Event, Venue, Show Date, Time & Seats of your preference as the logic flows.
- On the payment page, click on the “More Payment Options” & click on the ""Gift Voucher"" tab to enter the Gift Voucher e-code in the text box that appears & click on the ""Apply" button to avail the offer.
Book My Show Terms and conditions:
- Gift Voucher can be redeemed only on BookMyShow Website/Mobile App & cannot be redeemed directly at the Cinema/Venue Box Office.
- Gift Voucher can be redeemed on the purchase of e-tickets for Movies/Virtual Events/Plays/Concerts/Sports/BMS Stream available on BookMyShow.
- Multiple Gift Vouchers can be used in a single transaction or Gift Voucher can be combined with any other payment type on BookMyShow.
- Gift Voucher can be used multiple times until the last rupee loaded on it gets exhausted within the validity period.
- Gift voucher is valid for 6 months.
- Gift Voucher cannot be used to purchase another Gift Card.
- Gift Voucher work on non-extension clause & order once confirmed cannot be Cancelled or Refunded.
- Gift Voucher are valid PAN India across all Cinemas/Partners associated with BookMyShow.
- If lost misused, the Gift Voucher cannot be replaced. Void if resold, cannot be exchanged for points or cash & cannot be re-validated once past expiry date.
- In addition to these Terms & Conditions, BookMyShow Gift Voucher & their use on our Website are also subject to BookMyShow's General Terms of Use & BookMyShow's decision will be final in case of any dispute.

The "How to Participate" instructions mentioned on the Program Product form a part of these Terms & Conditions.
This Program is valid for citizens of India and extends to the whole of India
The Gift Card code cannot be redeemed after the expiry of the Book My Show code validity.
The participant by participating in the program agrees to waive off right of redemption upon expiry of the Book My Show code validity.
In case of any conflict between terms and conditions printed on the pack and these Terms and Conditions available on www.woohoo.in/hersheyshed website, the terms and conditions available on www.woohoo.in/hersheyshed website shall prevail.
Book My Show reward offered as part of this Program is non-transferrable, non-refundable; and no physical cash payment will be made in lieu of this. At any stage, Hersheys India Limited, and/or Organizer reserve their right to call upon the Participant to submit any document for verification of identity as per its sole discretion. Participant will be governed by the privacy policy of Book My Show.
Neither Hersheys India Limited nor Pinelabs Pvt. Ltd., will be liable for any delay in actual redemption under this program.
Organizer and Hersheys India Limited will not be responsible for any loss or damage to the Code due to wrong opening of the pack.
Under this Program, the vouchers are being offered directly by the Organizer. Hersheys India Limited is not responsible for any complaints/ queries received either directly or indirectly, with respect to any matter pertaining to this Voucher and the prize offered with this Voucher.
Hershyes India Ltd does not endorse the quality of any of the products or services being offered by the Organizer. Any complaints or queries pertaining to the same would have to be taken up directly with the Organizer for the support on the product or service. Concierge Lines are open only from Monday to Friday between 10:30 am to 5:30 pm and are closed on weekends /public holidays including bank holidays.
At any time, the Organizer and/or Hersheys India Limited reserves the right to update and/or amend all or any of these terms without further notice.
Hersheys India Limited and/or Organizer reserves the right to cancel, change or substitute Program at any time without any prior notice.
The Participant/s undertake and irrevocably and unconditionally permit Hersheys India Limited and/or the Organizers to cover the program through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest, or demur to such coverage in this regard.
The winners must, at the request of Hersheys India Limited and/or the Organizers participate in all Program related activities (such as publicity and photography) surrounding the winning of the Prizes, free of charge, and they consent to the Organizers using their name and image in the Program material.
All rights, title, and interest, including but not limited to the Intellectual Property Rights, in the Program material(s) and in all responses received shall vest with Hersheys India Limited and or its partners, respectively. Hersheys India Limited or any person or entity permitted by Hersheys India Limited in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Program, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
All material submitted in connection with the Program (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Hersheys India Limited upon submission and become the property of Hersheys India Limited exclusively. Hersheys India Limited may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Hersheys India Limited.
By participating in the Program, Participant(s) confirms to waive the applicability of rules and regulations of the National Do Not Call Registry (hereinafter referred to as “DND”) and agree and give their consent to be contacted by Hersheys India Limited and/or the Organizers for the purposes of this Program In case the customer finds a Program Product pack without code and files a complaint for the same or approaches the company with this complaint, then in that case Hersheys India Limited and/or the Organizers liability would be limited to providing the complainant with a new promo Code to enable him to participate in the Program as per this Terms and Conditions. The Participant cannot demand any monetary or other compensation for the same.
Organizer/ Hersheys India Limited accept no responsibility for any tax implications that may arise from the Program. Participants will have to bear incidental costs, if any, that may arise for redemption of the prize.
The Program is being conducted under the supervision of independent auditors.
Hersheys India Limited and its employees, directors and/or Organizers shall not be responsible for any loss, injury or any other liability arising out of the Program or due to participation by any person in the Program.
Hersheys India Limited and/or Organizers shall not be responsible for downtime on the services, caused due to technicalities (like failure of hardware equipment, configuration issue, network congestion), or due to decisions/changes in regulations that are carried out by TRAI, RBI, DoT or any other regulatory body.
Participant agrees that use of this Program is at his/her sole risk. Hersheys India Limited and/or the Organizer, their affiliates, and their officers, directors, employees, and agents disclaim all warranties, express or implied, including without limitation any warranty of merchantability, availability, and fitness for a particular purpose or non-infringement.
The Organizers and /or Hersheys India Limited shall not be liable to perform any of its/their respective obligations under the Program or in respect of the Gift Card Code Value where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, Global Pandemic or Epidemic, or any other force majeure condition, etc., and shall not be liable to compensate the Participant in such circumstances. The Organizers and/or Hersheys India Limited shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Program due to any government restrictions.
Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of the Organizers and Hersheys India Limited.
If a Participant is dissatisfied with the Program or the Program rules and/or any content or any requirements of the Program form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Program.
The Organizers and Hersheys India Limited shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of participation in the Program.
By entering the Program, the Participant hereby agrees to indemnify the Organizers and Hersheys from and against all and any liability, cost, loss or expense arising out of participation in the Program including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Program by conducting an illegal act. Participant also undertakes to indemnify Hersheys India Limited/the Organizers and/or their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by the Organizers and/or Hersheys India Limited on account of such act on the part of the Participant.
In consideration of the Organizers and Hersheys India Limited allowing the Participant/s to take part in the Program, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against the Organizers and/or Hersheys India Limited, their respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Program.
The terms and condition of this Program shall be governed by Indian Laws. The Courts at Delhi shall have the exclusive jurisdiction in respect of all the subject matter with relation to the Program.
Any costs associated with entering the Program, including but not limited to accessing the Program website, SMS charges to enter the Program, are the responsibility of each Participant. The Participant may be charged by their respective telecom operator as per their nominated tariff plan.
