By submitting an entry to the Program “RSPL Consumer PROGRAM” (herein after referred to as the “Program”) of RSPL Limited (“RSPL”), it is deemed that the participant (“Participant”) has acknowledged, read and understood these terms and conditions (“Terms and Conditions”), for participating in the Program which includes information on how to enter, how the winners of the Program will be determined, the prizes, and how personal data, upon participation, if required, will be collected, retained and used.

1. Before participating in the Program, please read the terms and conditions given herein. By participating in the Program, each Participant is deemed to have accepted the complete terms and conditions of this Program available on https://www.woohoo.in/ghadi microsite as well as the decisions of RSPL, which are final and binding in all matters related to the Program.
2. In case of any conflict, these Terms and Conditions will be considered final and binding in all matters related to the Program.
3. Eligibility:
   • i. Participant(s) must be a citizen of India, residing in India. Residents of other countries and residents who are not Indian citizens are not eligible to participate. Excluding - Tamil Nadu, Andhra Pradesh, Karnataka, Telangana and the union territories of Lakshadweep, Andaman and Nicobar Islands and Puducherry.
   • ii. The Employees, agents, associates, and promoters of RSPL and of its affiliates, subsidiaries, and advertisement agencies (including their immediate family members) and all others directly associated with organizing the Program(s) are not eligible to participate.
   • iii. The Program is valid only in India from 20/09/2023 to 20/11/2023. (Herein after referred as "Program Period”.
   • iv. All participation prior to the Program Period and after the end date of the Program Period will be considered as ineligible and will be summarily rejected.
   • v. The Program is subject to all applicable central, state, and local laws and regulations.
   • vi. Consumers participating or seeking to participate in the Program shall individually be referred to as "Participant" and collectively as "Participants".
   • vii. Regular call and message rates will apply as per the consumer telecom operator in their respective circle.
   • viii. RSPL/ its Agency reserves right to cancel / amend / extend the Program Period without giving any notice/intimation. No claims/questions shall be entertained in this regard.
   • 
     Participation by any person, who is not eligible under this clause shall be void. RSPL shall have a right to reject any claim, at any stage, from any or every ineligible participant or also to recover any consideration/prize or the value thereof at the sole cost and risk of such participants.
4. Agreement to Terms and Conditions:
   • i. By participating in this Program, Participants fully and unconditionally agree to and accept these Terms and Conditions available on https://www.woohoo.in/ghadi (“Program Website") as well as the decisions of RSPL, which are final and binding in all matters related to the Program. Successfully entering the Program and winning a prize is subject to fulfilment of all terms and
   • conditions mentioned herein. ii. RSPL reserves the right to exclude any person from the Program on grounds of misconduct, causing nuisance or indulging in criminal acts or criminal record.
   • iii. RSPL reserves the right to terminate, modify or extend the Program, at any time at its absolute discretion, without assigning any reason. All decisions of RSPL in respect of the Program and the prizes therein will be final and binding.
   • iv. If this Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of RSPL and/or its Agency, including but not limited to technical difficulties, unauthorized intervention or fraud, RSPL/ Agency reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Program, as appropriate.
   • v. If for any reason this Program is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of RSPL or the Agency, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Program, RSPL Reserves the right in its sole discretion to cancel, terminate, modify or suspend the Program.
   • (vi) Rights to use data - By participating in this Program:
     • a. The participant expressly confirms and represents that he/she has read the Terms & Conditions of the Program on how to enter, and details on usage, collection, retention and sharing of personal data.
     • b. The participant agrees to be bound by the terms, those relating to the collection, retention, use and sharing of personal data; and
     • c. The participant confirms that he/ she has gone through RSPL’s Privacy Policy and that he/she has no objection in collection or processing of their data according to the manner carved out in the privacy policy.
     • d. The Participant’s personal data as collected by RSPL’s associates/partners or affiliates shall be passed to RSPL. The personal data shall be administered and treated under RSPL’s privacy and data collection guidelines. Such data collected and retained may be used by RSPL and or its related associates/partners/ affiliates for marketing, internal study, and data analysis purposes.
     • e. RSPL encourages participants to read the privacy notice/policy of any such company before sharing personal data. If the Participant does not want his / her personal data to be collected by or shared with a company other than RSPL the Participant can always choose not to participate in such activity. If the Participant do opt-in to communications from such a company, remember that the Participant always have the right to opt-out and the Participant would need to contact that company directly to do so.
     • f. RSPL and the Agency shall not be responsible for (including but not limited to):
       • - For any SPAM generated messages
       • - For the Operator Code not being displayed on the user's mobile phones
       • - For any SMS message delivery failures
       • - Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason.
       • - If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign
       • - Other conditions beyond its reasonable control
5. A Participant can participate only one (1) time in the contest.
6. A Participant can be declared a winner of the competition only once throughout the Program Period.
7. In case a participant is shortlisted as a winner and is unable to fulfil the KYC details or is unable to complete other formalities as communicated by RSPL/Agency by 15 December they will no longer be eligible to be shortlisted as a winner
8. Entries are required to be submitted only according to the procedure described below. Entry submitted through any other mode/platform shall not be entertained. The decision of RSPL shall be final, binding, and non-negotiable.
9. The program is applicable on all the SKU of Ghadi cake.
10. Program Timings:
    • i. The Participants who send the valid and correct SMS during the Program Period (20/09/2023 to 20 /11 /2023) are eligible to participate in the Program.
    • ii. Time of participation will be defined as the time at which the entry is received through the SMS mode of participation at Agency’s computer system
    • iii. Entries coming outside the Program Period & Program Timings will not be considered for winner selection and will be summarily rejected. Customer will be notified via SMS to enter the Program during the stipulated timings
11. Entries must inter alia comply with the following guidelines:
    • i. All Entries submitted must comply with these Terms & Conditions given on the Program website.
    • ii. The Participant shall not defame, misrepresent, or contain disparaging or slanderous remarks about RSPL, its customers or its products, or other people, products, or companies.
    • iii. The Participant cannot depict, and cannot itself, be in violation of any law.

• How to Participate:
  • To participate, the 12 character alphanumeric unique code given inside the pack must be sent via SMS to the number mentioned VMN Unique code to 7799000511. Upon successfully sending the details the participant will be informed via SMS of their valid participation.
  • The participants are required to keep the pack with the unique code used for participation safe, as they may need to submit a copy of the pack with the visible winning code during KYC verification if they are shortlisted as a winner.
  • The Program will start at 00:00:01 AM on 20 September 2023 and end at 23:59:59 PM 30 November 2023 Any entries attempted and/or made before or after the prescribed/allotted Program duration will summarily be rejected.
  • Winner will get the SMS along with the URL to select the mode of transfer in case of cashback.
• Hourly Reward – 1 GM Gold Coin
  • Randomizer will select 1 winner every hour and a SMS communication will be sent to the winner the next day.
  • SMS will have a web-form link and the winners will click on it to get redirected.
  • Winners will visit the link and enter the reward code for validation.
  • Post validation the user will move to the next step.
  • Winners to fill in the delivery address details along with KYC documents.
  • Winner to upload the PAN card & any relevant address proof details along with the soft copy of the PAN card.

  • Customer can raise a query/complaint within 3-5 business days of the delivery. Post that no complaints can be registered. This is specific to the gold coin only.

  • Randomizer will select 1 winner every day and a SMS communication will be sent to the winner.
  • SMS will have a web-form link and the winners will click on it to get redirected.
  • Winners will visit the link and enter the reward code for validation.
  • Post validation the user will move to the next step.
  • Winners to fill in the delivery address details along with KYC documents.
  • Winner to upload the PAN card details along with the soft copy of the PAN card.
  • KYC details will be validated at the back end.
  • Winners will receive a call from the rewards team confirming the nearest/preferred outlet from where they want to redeem the voucher.
  • Customer care executive will call the winner and inform him for TDS submission to the RSPL group – ANANT from RSPL will be the POC for that
  • A deduction of TDS will be applicable as per the government norms (section 194b of the IT ACT 1961) (presently it is 30% on winning prize).
  • Post Submission of TDS & valid documents to RSPL, RSPL will arrange gift voucher or ACTIVA for the winner within 15 days.
• In Case of Voucher-
  • The voucher will be sent physically to the winner.
  • Winner will take the voucher to the mentioned outlet and redeem.
  • ON ROAD price voucher will be given to the winner
  • Showroom team will call and confirm the winner upon receiving the vehicle at the showroom for collection.
• Bumper Reward – 4-Wheeler
  • Randomizer will select 1 winner every month and a SMS communication will be sent to the winner.
  • SMS will have a web-form link and the winners will click on it to get redirected.
  • Winners will visit the link and enter the reward code for validation.
  • Psot validation the user will move to the next step.
  • Winners to fill in the delivery address details along with KYC documents.
  • Winner to upload the PAN card details along with the soft copy of the PAN card.

  • Post reciept of valid documents RSPL will release the voucher of the car to the user within 1 month.
• In Case of Voucher-
  • The voucher will be sent physically to the winner.
  • Winner will take the voucher to the mentioned outlet and redeem.
  • RSPL will provide a coupon upto Rs. 10 lakh to the winner.
  • Showroom team will call and confirm the winner upon receiving the vehicle at the showroom for collection.
• • For all the above rewards there will be a specific period during which the winner must fill in the form to claim the reward. If the winners don’t fill the webform within the timeline, then he/she will not be eligible to get any reward.
  • Colour of the vehicle is subject to availability and cost. RSPL team to confirm on the specific deliverables for the rewards.
  • The Winners will be randomly selected (basis randomizer system) Winner will not be selected from the state of Tamil Nadu as the Program is not for State of Tamil Nadu.
    • a. A draw through random scientific selection will be conducted every day to select the winners.
    • b. Prizes will be given subject to the winner satisfying the verification process of RSPL or the Agency.
    • c. Participants have a chance to win ONE time only from a single mobile number.
    • d. Participants have a chance to win ONE time only from one unique code.
    • e. The winner generation will be done based on Valid Code and mobile number.
    • f. RSPL and Agency shall have a right to ask for the original pack with the unique code in case of any query raised by the Participants during the Program Period, non – submission of which shall render the Participant as not eligible to participate in the Program.
  • The cost and expenses incurred towards conducting and administering the Program are being borne and incurred by RSPL out of its own funds and same are not being recouped in any way from the Participants.
  • The prize(s) are non- transferable and non-negotiable.
  • The use of internet and SMS may be chargeable at the regular tariff rates. Consult beforehand with your service provider to know these charges. If entries are received for participation, it is assumed that the person sending in the entry has provided us with the permission to send SMS to or call him/her, whether such sender is registered on the National Do Not Call Registry.
  • Entries submitted by the Participants which do not comply with these terms and conditions will be rejected. RSPL reserves the right at its sole discretion to disqualify any such entry at any time. Incomplete information provided or failure to provide true and accurate information, failure to submit proof of identification and/or original confirmation number will automatically disqualify a participant. RSPL shall have the absolute and sole discretion to determine whether any participant should be disqualified or exclude any person from this Program, by reason of failure to abide by these terms and conditions, bad faith, fraud, or any other reason, at any given point of time. The decision of RSPL with respect to such disqualification will be deemed as final and no correspondence will be entertained by RSPL.
  • Mere participation in the Program or submitting the Comment(s)/ Pictures does not entitle the participant to the prize(s) unless all other terms and conditions are fully met. Failure to comply with any of the terms and conditions hereof or any fraudulent conduct shall disentitle the participant.
  • By entering the Program and accepting the prize, the Participants and prize winner(s), respectively, stand to waive all such rights inherent and otherwise under copyrights, rights of publicity and any related rights. The Participant, upon participation in the Program, willingly and of their own volition, consent to RSPL’s right to audio graph, videography, picture, tape or portray him/her as a participant/ prize winner and to exhibit this material in any and all media now existing or hereinafter created, including (without limitation) television, film, radio and print media without any compensation whatsoever for such advertising and publicity for perpetuity, except where prohibited by law.
  • By participating in the Program, each participant agrees to hold harmless RSPL and its affiliates, directors, officers, employees and agents, as well as all others associated with the development and execution of this Program, from and against any and all liability with respect to or in any way arising from this Program, the awarding and use, misuse or possession of the prize, including liability for personal injury, except where prohibited or limited by law.
  • RSPL reserves the right to change the terms and conditions of this Program and to alter or terminate the Program at any time without prior notice. The link with an updated version of the terms and conditions will be available on the microsite https://www.woohoo.in/Ghadi.
  • RSPL shall not be liable for any failure to comply with its obligations mentioned herein, caused by any pandemic, epidemic, weather conditions, fire, flood, hurricane, strike, war, riots, political unrest, civil commotion, terrorist attacks, or any other event amounting to Force Majeure and beyond their control.
  • The Program is applicable only for participants residing in India. The Program is not available where specifically prohibited by any law.
  • By participating in the Program, each participant specifically accepts as follows (a) that he/she has fully read and understood all the terms and conditions and be unconditionally bound by them b) that he/she satisfies the eligibility requirements under these rules c) that he/she unconditionally accepts the winner so selected d) that he/she shall honour all decisions of RSPL with regard to the Program and its interpretation and not challenge them (e) to comply with all Central, State, Local Laws and Regulations.
  • Program Participants agree to indemnify and hold harmless RSPL and its affiliates, and each of its and their officers, directors, employees, consultants, licensors, agents, and representatives from and against any and all claims, losses, damages or liability that may be asserted against or incurred by any of them at any time, in connection with entry, or participation or use of the Program, or by respective Program Participant’s breach of any agreement or warranty associated with the Program.
  • This Program is governed by Indian laws and is subject to all applicable laws.
  • RSPL and its related companies and agencies will not be liable for any loss (including, without limitation, indirect, special, or consequential loss or loss of profits), expense, damage, personal injury, or death which is suffered or sustained (whether arising from any person's negligence) in connection with this Program or the acceptance or use of the vouchers/ gifts. It is clarified that the vouchers/ gifts shall be accepted by the Program Winner in the form and manner provided by RSPL, and RSPL shall not be liable for any loss or damage related thereto.
  • The acceptance of the Terms and Conditions of the Program shall be deemed to have been given at Kanpur, Uttar Pradesh, India and the courts in Kanpur alone shall have exclusive jurisdiction to entertain any proceedings in any way relating to or concerning these Terms and Conditions of the Program or any rights, duties, obligations or liabilities arising there under to the exclusion of all other courts in India.
• Qualification
  • Completion of KYC process will be mandatory to be eligible to receive the prize. The KYC process will have to be completed by or before 15th December 2023.
  • The Participant agrees to receive communications from RSPL and/or Agency including, but not limited to telephonic calls.
  • RSPL holds the right to remove someone as a winner if found spurious, or if the same individual has already won a prize prior in the promotion duration.
• Announcement of Winners
  • If shortlisted as a winner Agency will send congratulation SMS along with a link to upload the KYC documents.
  • The winner stands a chance to receive cash prize up to Rs 500 OR 1 one gram Gold coin OR 1 two-wheeler OR 1 car.
